Recent Regulatory Action (2026)

In February 2026, DTSC issued an Imminent and Substantial Endangerment Determination and Order (Order) relating to the discovery of TCE in soil gas off of the property to the southwest, beneath the Euclid Terrace Apartments.

Magellan Aerospace, Middletown, Inc. (the successor to the former aerospace operator that caused the contamination) had previously declined to participate in any required work. DTSC used its regulatory authority to require Magellan to take part in the investigation and cleanup.

Market Creek Plaza LLC (MCP) did not cause the contamination and has been voluntarily working with DTSC over the past two years to investigate and address on-site conditions, including improving indoor air quality at the Food 4 Less store. Even though MCP did not cause the contamination, it is also named on the Order because it owns the property and under applicable law, may be held responsible for site conditions, regardless of the cause. The Order sets specific requirements and deadlines to ensure work is completed, including off-site investigations and mitigation measures.
